Capital construction investment tops NA agenda session
Changes are to be made in the Construction Law, the Bidding Law, the Law on Environmental Protection, the Enterprise Law, the Land Law and the Housing Law.
The deputies stressed the need to amend these laws to iron out snags and create a transparent legal environment for capital construction investment. Deputy Tran Du Lich from HCM City proposed removing “bottlenecks” in administrative procedures that prevent the implementation of capital construction investment projects. He said that there is no need to get a construction license once a business has an investment license, citing the fact that it takes businesses too much time to get such a license.
Some deputies said that the National Assembly should allow investors to adjust the overall capital balance sheet of the project when material prices fluctuate and are approved by the authorised agencies. Other deputies argued that any adjustment should be taken into account as this could cause negative effects.
Discussing the Bidding Law, deputies asked for tougher fines to be imposed on law-breakers as many negative practices have been seen in bidding activities. Deputy Pham Thi Thu Ha from Dong Thap province pointed to the fact that bidding in Vietnam focuses more on financial than technical aspects and that it is hard to know that someone has broken the law more than once. She proposed that contractors include a paper certifying their capacity in dossiers submitted to the authorised agencies.
