The new rules on procedures for granting work permits to foreigners working in Vietnam

 ince November 1, 2013, work permit (work permit) of foreign labor (labor NN) subject to the Government’s Decree No. 102/2013/ND-CP dated 05 December 2013 09 (hereinafter referred to as ND102 ) replace Decree 34/2008/ND-CP and Decree 46/2011/ND-CP amending and supplementing a number of articles of Decree No. 34/2008/ND-CP.

Decree 102 and the provisions of the Labour Code in 2012 was related to the new profile, the procedure for grant as well as the duration of the work permit of foreigners working in Vietnam.

First : Profile for granting work permits:

1 - Office of the Chairman of the provincial People’s Committee for approval of the use of foreign labor. (Enterprise identified the need to use foreign workers for each job that the employee Vietnam not meet the accountability and reporting)

2 - Certification of managers, executives, professionals, technical labor:

2.1 On the level of experts, technical regulations: the Labor Professionals NN NN has been recognized as professionals or skilled laborers agricultural engineer, bachelor or higher degree or equivalent and have at least 05 years of specialized training.

2.2- LD is the LD technique NN was trained in engineering at least 01 years and have worked at least 03 years of specialized training techniques.

3-02 color photographs (size 4cm x 6cm).

4 - A copy of passport or documents in lieu of passports valid under the law.

Monday : The duration of work permits a maximum of 02 years.

Third, procedures for extending the work permit procedure is replaced by a new permit labor.

Wednesday , Decree 102 also revised working conditions for laborers in Vietnam’s agriculture is capable of full civil act instead of just as before the age of 18.

Thursday:Adding procedures to verify the absence of grant subject to a work permit under the provisions of Article 172 of the Labor Code.

Also, ND102 adds 3 cases work permit recovery than before, and more specifically the conditions foreign laborers deported from the territory of Vietnam in 15 days while working in Vietnam without a work permit .

Therefore, enterprises need to find out more detail about the new procedure for work permit to explain plans for vacancies, select eligible candidates for work permit procedures and work permit reissued. /.
