TPP impact on Vietnam’s legal reform, with focus on labor and employment

Event Description
We would like to invite you to a breakfast meeting co-hosted by the HR and Legal Committees of AmCham on “TPP – Impact on Vietnam’s legal reform with special focus on the employment and labor area”. 
 
The Trans-Pacific Partnership (TPP) is a trade agreement among twelve Pacific Rim countries signed on 4 February 2016 in Auckland, New Zealand, after seven years of negotiations. The TPP is arguably the most important trade agreement that Vietnam has entered into since its 2007 accession to the WTO, and it is expected to bring a new boost for the Vietnamese economy. From the legal point of view, the TPP requires member nations to conform their laws with the commitments they have undertaken in the agreement, including international labor and environmental standards, among other things. This will bring significant change to Vietnam’s legal framework in the years to come.
 
In particular, the labor chapter and the side agreement that Vietnam signed with the United States present several significant commitments of Vietnam to reform the employment and labor law, and as a result, impact on the nature of the relationships between employers, employees and especially trade unions.
 
At this breakfast meeting, you will hear from the subject matter experts – Mr. Fred Burke, Managing Partner and Ms. Hang Nguyen, employment partner of Baker & McKenzie Vietnam, who will discuss the impact of the TPP on legal reform of Vietnam in general, and on the employment and labor landscape in particular.

Mr. Fred Burke, Managing Partner, Baker & McKenzie Vietnam
 
Fred has twenty-six years’ experience in the planning, negotiation and operation of cross-border trade and investment projects in Vietnam and China, as well as in the related issues of finance, regulatory compliance, property development, construction, securities, finance, tax, labor and dispute resolution. Building on his experience with the Bilateral Trade Agreement between the United States and Vietnam in 2000, and Vietnam’s accession to the WTO in 2006, he has recently been devoting his energies to the successful conclusion of the Transpacific Partnership Agreement. This new agreement would provide substantial opportunities for AmCham members in terms of trade and investment, market access and protection of intellectual property rights. By providing a much needed stimulus to the Vietnam economy, the TPP would also offer new opportunities for Am Cham members operating here.




Ms. Thuy Hang Nguyen, Partner, Ho Chi Minh City, Baker & McKenzie
 
Ms. Nguyen is a Partner in our Ho Chi Minh City Office, who is admitted to practice law in New York and Vietnam.  Since joining Baker & McKenzie in 2006, she has provided legal advice and assistance on a wide range of practice areas in various investment projects and has advised on transactional, corporate and regulatory issues in Vietnam, including employment and labor, merger & acquisitions, compliance, corporate and commercial.
 
Ms. Nguyen heads the Firm’s labor and employment law practice group in Vietnam and is part of the wider Asia Pacific and Global Employment Law Group of the Firm.  She advises on all types of employment and labor matters, in both contentious and non–contentious issues, but she particularly focuses on labor regulations compliance, employment aspects of major transactions and corporate restructurings, global migration and executive mobility, restrictive covenants, labor relations and unions, and labor dispute resolution.
 
Ms. Nguyen is the Chairwoman of HR/Labor Committee of American Chamber of Commerce, Ho Chi Minh City Chapter, and is a leading authority and frequent speaker on Vietnam employment and labor law in Vietnam and the region.
 
Ms. Nguyen holds a B.A. in International Law from the Diplomatic Academy of Vietnam, a LL.M. in International and Comparative Law from Southern Methodist University’s Dedman School of Law, and an Executive MBA from the University of Hawai’i at Manoa’s Shidler College of Business.
